Limitations on Wrongful Death Suits

There are other twists and turns in this area of the law that deal with other

employer's liability.


Employer's are required by law to carry insurance for workers that compensates them

This means the amount a worker recovers is limited, but recovery is guaranteed.

Many people don't fully understand what wrongful death means. The easiest definition
to understand is that means taking of the life of another due to a
deliberate/negligent act by another. If a person dies due to the wrongful conduct of
another, the deceased's relatives may file a wrongful death lawsuit.

Interestingly enough, wrongful death statutes were originally brought into being to
give financial support to widows/orphans and to act as a motivator for people to
take care in their actions involving others.

A wrongful death action is not a criminal charge and neither of the proceedings
crosses over into the other. This means if a defendant gets an acquittal for murder,
they may be sued in a civil action for wrongful death.

Actions brought under this statute may be launched for either unintentional or
intentional acts that caused injury or death. In all cases of wrongful death it
makes good strategic sense to speak to a fully qualified wrongful death attorney to
ensure proper settlement in a court of law.
